CRA of Mayotte: indecency to the end of words (by Remi Carayol)
Two days after the broadcast on the website released a video showing the conditions "unworthy" which are hosted at the Center's administrative detention Pamandzi undocumented migrants expelled from Mayotte, the prefecture has sent a response to media on 20 December 2008 (see note above). Two days of reflection that enabled authorities to find a semblance of paradise. It is actually a mixture of bad faith and contempt worthy amalgam of French authorities in Mayotte developed for several years vis--vis the rights of foreigners, and more generally foreigners themselves ...
Fighting for Human Rights publishes the ticket to stir Carayol, a journalist led to the publication of the video release. Attacked? Hot? press release of the prefecture.
An "exception" recurring
"The day was filmed video," said the prefecture, "is the worst situations." "On 22 October is the only day on the last four months, where the figure 200 was chosen over", swear the authorities. The average over that period would be 80 days held by ...
Reflecting on anonymity, an official of the PAF ensures that "we still exceed the figure of 200, and we are mostly above 150". Another officer of PAF confirms that "we often expect nearly 150 selected."
On 10 October 2008, said the Cimade-Mayotte, "there were 143 people" in CRA. Another source penetrating regularly within the CRA, on December 18 last, there was a big hundred selected, "and others were to arrive in the evening."
Like what the "worst situation" tends to repeat itself ...
[CHR Note: In addition to extend 16 000 people a year, on average CRA receives 43 persons / day if they remained 24 hours. But as they remain on average 48 hours, we are in an average of 86 passengers per day and if they stay 5 days, as was regularly the case, it is necessarily in occupancy rates much higher, especially since the present number of CRA is highly dependent on police activity and should hear hollow weekends and holidays].
An "exception" disturbing
According to the prefecture, "the period during which was filmed the video was exceptional." This October 22 2008, 202 people were inside the CRA, designed to accommodate 60. "In normal circumstances," said the press release, "the prefecture and the direction of the Police and air borders to ensure organize renewed as soon as possible to save people renewed expectations useless in a few adapted and to avoid overcrowding the center. This policy is useful because it finds that the waiting time in the center is about 24 hours, exceptionally 48 hours. "
It is a reality that calls for two comments:
1. This quickly to deport undocumented migrants is the cause of many violations of the rights of aliens, encouraged by the lack of suspensive appeal to the administrative court. "Regularly, people who should not be returned (French, unaccompanied minors, parents of French children, foreigners living in the territory for 15 or 20 anas and having all their ties in the territory, etc.) are because the authorities do not take the time to check, "said a member of the collective Migrants Mayotte. And because some are escorted to the border 2 or 3 hours after being arrested, and most of the time without having the opportunity to explain their situation.
2. This speed is not always possible: it is not uncommon for selected staying three to four days in the CRA, whose film shows how it is unbearable.
Of "complications" indecent!
According to the prefecture, the machine was halted mid-October, when "the Anjouan authorities have made renewed operations by imposing additional conditions, then even banned several times before a release was obtained by the diplomatic . "What" complications "- slightly derogatory term - is it? Last October, the government of Anjouan demanded that the French authorities are:
-? A detailed list of Comorians returned 24 hours before their escort to the border?;
- It is allowed to returned? Dress with dignity? and? retrieve their belongings? ;
- That minors? Be accompanied by an adult with an appropriate status?, In other words: a parent, guardian, an uncle, etc ..., not a stranger, as have become accustomed to do with the French authorities deported minors in violation of the law - a recently denounced by the Ombudsman for children.
These "complications" more akin to a minimum of rights and decency - is consistent with the requirements of French law - but the Prefecture does not seem to attach much importance to these two concepts - also blithely ignored by the Comorian authorities.
From a certain threshold and the law
It should according to the prefecture "put [the film] in the context of issues of immigration to Mayotte. Followed two paragraphs of complacency striking in view of numerous breaches of French law to reach a total of 16,000 extended to the border a year, and a series of figures to fear, especially that of developing a disturbing theory: since the situation is exceptional (and so incidentally, since foreigners are a source of crime, as stated openly communicated), it is possible to override certain rules, even the French and international laws. It is also believed that members of the Committee on Legislation of the Senate who, during a meeting with members of the collective Migrants Outremer, had made it clear that the law only applied to be below d ' a certain threshold of the persons concerned ... ? Beyond a certain threshold, it can not enforce the law, it is a matter of public policy? had heard members of the group about law enforcement Jules Ferry in 1884 on the education of all children ...
At least, the limit civil liberties is clear.
"A situation well known, but well masked
The epitome of indecency seems to be reached in this release of the prefecture, when it states twice that "the situation of Mayotte CRA is well known." The center has been the subject of ministerial visits, prefects, journalists, the CNDS, most recently the defender of children. " Certainly ... The fact that every time, the center had been cleaned and mostly emptied of much of its occupants, so that the figure of 60 is barely over, seems to be a retail interest authorities - detail yet they try to repeat carefully.
According to an official of the PAF, minutes before the arrival of members of the CNDS came to Mayotte in December 2007, management had asked those who had moods to leave the premises ... On the other hand, should specify that no journalist can not enter the CRA without asking permission several days prior to the direction of the PAF?
Furthermore, says the prefecture, the CRA "has never been hidden to anyone." Go figure, then why Cimade-Mayotte is still not authorized by the Immigration Department to enter inside the CRA when it sees fit, as is possible in all other CRA France and Overseas, despite a request made in early 2008 - or almost one year! Who knows why the CRA of Mayotte is the only one not to be affected by the tender of the Department of Immigration on the information of short-effective access to their rights - which means that no legal assistance financed by the state may take place in the coming years - except to get a specific audience in Mayotte!
Press freedom: the "pirates" and prey to the prefecture
The epitome of indecency has not been fully achieved ... For the prefecture, "seeking pictures or information through illegal means such as shooting a video pirate, interception of a journalist in a boat with Comorians trying to enter illegally in Mayotte, n ' not provide solutions faster or more effective. " It will quickly design that is the prefecture and its heads are (sic) of journalism, which according to it (them) is good to bring "solutions" ... Tell, testify, especially when it bothers: this is a silly idea! It will also on the term "hacker" used in the same logic as above, that of "complications". These two terms demonstrate how the prefectural authorities live in a bubble which seems to exclude any alternative to Manichaeism.
But the most severe sentence in this amalgam is made between the film and the fact that a photographer was arrested last October in a Kwassa, while he did his job. Had it not the right - the duty - to keep these migrants and witnessing the conditions of the crossing ?...
It is now clear that the prefecture, the journalist is good to monitor patrols of the PAF (in trips organized) and relaying the discourse of the authorities, without trying to go further - in this case beyond the .
Right of foreign right of the press even fight!
